UPS really screwed me over ... they were supposed to deliver 5 complete new computer systems that I special ordered for a new store opening up in town here.
My contract stated that this new store needed these new systems by yesterday (grand opening) or they will go with a backup source. Needles to say, it didn't come yesterday and this is what the tracking # shows :
PACKAGE MISSED, NO DELIVERY ATTEMPT MADE;UPS INTERNAL ACTIVITY CODE
How the hell can they forget to load my package on the truck ...
Ok fine, this new store was gracious enough to give me till the end of today to come up with the new systems .. still never received anything from UPS today. (even after several calls to them and they assured me it was going to be here)
Now i have $9000+ worth of computers equipment that will be delivered tomorrow (which is no longer needed) and I'm responsible to send it back to my wholesaler and RMA it.
Lost out on $1000's of profit on this one .. this is going to sting for sometime ...
Can they be held accountable in anyway for this?
Boy, that is a good question. At the very least i would speak to a UPS rep and insist that they pick up the return shipping.
I guess you could speak to a lawyer but they might eat up a large portion of any settlement.
In my experience and dealings with UPS...they only guarantee delivery by a certain day and time. Provided you used anything other than ground service. The extent of the guarantee can get your/wholesaler's intial shipping charges refunded. I don't know that they have any liability other than that. :-\

I suspect that lost profits would be a tough one to get a judge to go for. Do you have a contract with UPS? What does the contract say? I suspect the judge would tell you to go after your supplier if you were damaged by their decision to use UPS, but you probably need your supplier.
Your best outcome is probably convincing your supplier to take back the product and convincing UPS to suck up the shipping costs.
You are probably best off going to the gym and taking out the frustration and anger on the heavy bag. This bump on the road probably won't make one bit of difference to your life five years from now.

Oh, to answer you question .. no, I have no contract with UPS. I just chose them cause the rates were good.
Fedex is definitely an option, and one I will take from now on.
I'm done with UPS.

No ... but that would seem easier to handle than what i've been going though this year hehe
I've been through some stressful situations and so far nothing compares to divorce. lol
I suppose being diagnosed with a potentially fatal disease would be more stressful, but I have never been through that so I don't know.

Sounds like someone at UPS got a new computer or 2, I try to ADVOID UPS, i try to get everthing i order on the net delivered by USPS... I agree with Bob, UPS does suck..

Yeah, there very common these days. Mine used to be electric years ago and it went kaput so rather pay an electrician to figure it out, I paid $10 for a battery operated one. Took me 5 minutes to install. ;)
It doesn't matter if we have a doorbell or door knocker when people come to our house they blow the car horn.
What really pisses me off when strangers drive up the driveway, blowing the horn expecting me to come running out and ask "how can I serve you?".....we live a good distance away from the road plus our driveway is pretty steep and yet they still come bother us asking where such and such lives. >:(
Other than that I love the good old country living, deer running around in the yard, rabbits humping errrrr hopping around..... :P nice and peacefull here as long as people don't blow their stupid car horns. Not even UPS or FedEx can find our house... been waiting 2 weeks now for my recovery disk from HP you think I need to call and give them directions? ;D

I phoned UPS once again this morning and spoke with the office that was handling my parcels and they say :
It was loaded on the truck in the morning (monday), but when it came time to deliver it to my house ... they were gone.
Someone stole a bunch of packages from the back of the truck during one of his deliveries.
Now i have to file a $9000+ claim with UPS .. and god knows how long it'll take to get my money back.
My CC is maxed and have nothing to show for it.
I have a headace ... and I'm going to lay down for awhile.
not to be mean or anything, you must have a sucky credit card, most credit cards you can file a disbute over and they will take care of the matter no matter what... I had the same problem, but i ordered a Police Scanner from a very well known place on the net used my credit card, 2 days later when UPS didn't bring it, I called my credit card company and said i didn't recieve it.. evens though CC company couldn't find out where it got too, the place i ordered it from said they sent it, I didn't have to pay anything at all...If i was you, i start by calling you CC

Damn... Good luck with that Mayhem. I would be more than pissed off if that happened to me. I am sure there is something you can do to at least get the moeny knocked off your credit card... And then sue UPS...
And then, never use UPS again.

OMG thats absolutely horrible Mayhem :'(. Did they give you any idea how long it will take to get your money back? I would imagine there has to be an investigation first. I hope somehow everything works out for ya. I hear about people stealing from ups all the time(usually the driver is in on it). Since UPS delivers old women their pain meds, the drivers will get paid for info on when and where the truck will be open. The theives just walk right up to the truck and take them. For something as big as you are talking the driver would almost have to be in on it.

Standard UPS procedure is to file a trace on my package (which will take 15 business days) .. if they can't find it, the police will be called in due to the fact there's so much money involved (investage the driver / company). Then it will take another 10 business days to file a claim and to receive a refund.
Somebody shoot me .. I've suffered enough.

Um, so they wait 15 days for the trail to go cold before they call in the police? I don't think I would wait that long.
Do you have standing to call the police and make a report yourself?

They just told me that if they couldn't find the packages, the police will be involved.
I'd get a lawyer... UPS has been one of the worst companies I've ever dealt with...
Here's my sad story with UPS...
So I bought a new mother board about a year ago... Went to set up my brand new cpu and guess what happens, I'm a dumb-ass and set the MB on the carpet and it gets static shocked and dies... So I send it in to MSI and get a new one sent out to me... It comes, I install it and then my computer refuses to boot up... So I've got a buddy that gets parts at a whole-seller price and can hook me up, so I decide to just send my system off to him, and have the whole thing revamped (I was just too tired of screwing the damn thing up)... So I package my box up and take it to the UPS store... Now mind you I took special care to make sure it was packaged as carefully as possible (3 inches of packing on every side of the box), I even put in a towel inside the case, incase anything fell out on it's trip... Then I pay for up to $2k worth of insurance on 5 day ground shipping... Off it goes... So 6 days later I get a call from my buddy who has my computer... He says he has really bad news... UPS utterly DESTROYED my computer... It was dropped so hard, that the screws that hold the hard drives in place were cut in half; that's right the metal plate that holds between the screw and the HDD has pushed so forcefully into the screw that it split it in half... On 4 screws for each drive!!! So during it's shipping from Utah to Tennessee there were 4 nice HDDs just flopping around with only a small towel to try to stop them from jacking up the entire machine... So I go ok, lets file a complaint and get my cash on the insurance I paid for... They come out to his house take pictures, check the packaging blah blah blah... All in the mean time I give my buddy the cash to go purchase new parts to check out... So he rebuilds the machine and sends it out to me... Again great packaging, insurance the whole bit and deal on it... Off it goes... It gets to my house with a huge whole on the side of the packaging... I open it up and come to find that something slammed into the side of the box (the side where the motherboard is screwed onto the case) that it cracked the motherboard into pieces, pushed the processor and fan kit off the fitting and broke 4 pins off of the processor in the process... So I call again and file a second claim to get the insurance cash back... They come out do the whole bit and deal for awhile, pictures blah blah blah... And they leave... On both cases I don't hear from anyone who knows for almost 3 months... I call the Office Depot store (where I shipped it via UPS), they say to call UPS... I call UPS, they say call Office Depot... Finally I find someone who knows at UPS... Eventually they decide they will not pay the claim because the box was packaged incorrectly... On both claims... Funny thing is, I packaged it in the exact same manner as HP, Dell, Gateway, Sony, etc... So after fighting with them for 3-4 more months I finally gave up... I figured the best way to get back at UPS, is to get a lawey and start a class action lawsuit against UPS for their insurance racket that they run... I like to go **** with the UPS people all the time now though... Every few weeks or so, I roll over to the parking lot and start passing out fliers about my story with UPS trying to get people to use FedEx or the USPS... I ****ing hate those bastards now... >:(

Good news is that they found my computers!! They were in a back room of a gift shop (in town). I was given no explainion on why they ended up there ... only that i'd need to bring my receipts and 2 piece of ID to pick them up. They had been sitting there since June 7 ... but the tracking # shows this (for that date) :

I honestly think the driver was try to scam me and his own company. UPS has promised me full refund for all shipping costs to / from my distributor ..
I'll never use them again, and i'm in the process on getting an account with Fedex.

Doesn' Surprize me either, because they have done something like that to me Fatkid, I had my Dell comming, UPS was Suposed to deliver it and WHEN i fianlly get the computer , Its all banged up :'( but i ended up getting a new computer and i got all shipping free ;D . I use Fedex now too I will never trust UPS again ever scince that Insadent.
